1. Agreement to Terms

By accessing or using the HSE Advisor Canada website (www.hseadvisor.ca) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Use of Services

Eligibility

You must be at least 18 years old to use our services. By using our services, you represent that you meet this age requirement.

Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

Corporate and team accounts are available for organizations wishing to manage course access for multiple employees. See Section 4 for details on corporate account terms.

3. Course and Content Access

License Grant

Upon purchase, we grant you a limited, non-exclusive, non-transferable license to access and use the purchased courses and materials for personal or internal business use only.

Consulting Retainer Clients

Organizations engaged with HSE Advisor Canada under an active consulting retainer agreement receive complimentary access to designated courses as a benefit of their retainer package. This access is provided at no additional charge as part of the consulting relationship and does not constitute a resale or sublicensing of course materials. Complimentary access is limited to employees of the retainer client organization and is subject to the same use restrictions described below.

Restrictions

You may not:

  • Share, distribute, or resell course materials
  • Copy, reproduce, or modify content without permission
  • Use content for commercial purposes without authorization
  • Remove copyright or proprietary notices
  • Share login credentials with others

4. Corporate and Team Accounts

Organizations may create corporate accounts to manage employee course enrollments. Corporate account administrators may assign and manage course access for their organization's employees. By creating or administering a corporate account, the organization agrees to:

  • Ensure all assigned employees comply with these Terms of Service
  • Maintain accurate records of authorized users within their account
  • Promptly remove access for employees who are no longer authorized
  • Accept responsibility for the use of the account by their employees

Corporate account pricing and seat allocations are governed by a separate agreement between HSE Advisor Canada and the organization.

5. Payment Terms

Pricing and Payment

  • All prices are in Canadian dollars (CAD)
  • Prices are subject to applicable taxes
  • Payment is due at the time of purchase
  • We accept major credit cards through Stripe

Refund Policy

We offer a 30-day money-back guarantee on course purchases. Refund requests must be submitted within 30 days of purchase. Downloaded materials and completed courses may not be eligible for refunds.

6. Intellectual Property

All content on our website and in our courses, including text, graphics, logos, images, and software, is the property of HSE Advisor Canada or our licensors and is protected by Canadian and international copyright laws.

7. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit viruses or malicious code
  • Attempt to gain unauthorized access to our systems
  • Harass, abuse, or harm other users
  • Use automated systems to access our services
  • Engage in any activity that disrupts our services

8. Professional Services Disclaimer

Consulting services provided by HSE Advisor Canada are delivered by professionals holding recognized credentials, including Certified Registration Safety Professional (CRSP) designation and ISO 45001 Lead Auditor certification. These services are tailored to the specific needs of each client engagement as described in the applicable service agreement.

Course content offered through our platform is designed for awareness-level training. It is intended to build general knowledge of health, safety, and environmental topics and does not constitute professional advice for specific workplace situations. Organizations should engage a qualified HSE professional when addressing site-specific hazards, regulatory compliance requirements, or matters requiring professional judgment. Completion of a course does not certify competency or fulfill regulatory training obligations unless explicitly stated in the course description.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our services are provided "as is" without warranties
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for the specific service
  • We are not responsible for third-party content or services

10. Indemnification

You agree to indemnify and hold HSE Advisor Canada harmless from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

11. Privacy

Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms of Service by reference. We use third-party tools to improve the reliability and usability of our platform, including Google Analytics for traffic measurement, Sentry for error monitoring, and PostHog for product analytics. These tools may collect anonymized or aggregated data about how you interact with our site. Please refer to our Privacy Policy for details on data collection and your options.

12. Modifications to Services

We reserve the right to:

  • Modify or discontinue services at any time
  • Change prices with reasonable notice
  • Update course content and materials
  • Limit access to certain features

13. Termination

We may terminate or suspend your account and access to services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in Ontario, Canada, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HSE Advisor Canada regarding the use of our services.
